The the ACT rules, in short

  • New pools require building approval with a barrier meeting AS 1926.1.
  • No certificate to sell or lease - but barriers must comply, and building reports at sale flag defects.
  • Older pools are assessed against the standards of their era; new barrier work meets current rules.
  • The 300mm rule applies - spas and portable pools need compliant barriers too.
  • Certificate to sellNoneBarrier must still comply
  • StandardAS 1926.1Via ACT building law

The full picture, including registers, fines and edge cases, is in the the ACT pool safety guide. Not sure what applies to you? The pool compliance checker covers every state and 285 council areas.

What the inspection covers, and what fails most

The inspector checks the barrier against the standard that applies to your pool: fence height and gaps, gate self-closing and self-latching, the non-climbable zone, boundary fences used as barriers, and the CPR sign. You get a written list of anything that does not comply, then a window to fix it and be re-inspected. Most fails are cheap to fix, and most are visible in a twenty-minute walk around the pool before the inspector arrives.

Common fail itemBallpark fix
Gate doesn't self-close or self-latch$30-$150 DIY, $150-$400 tradie
Latch release below 1500mm$50-$200
Climbable objects within the non-climbable zonefree to $100
Gaps over 100mm under or between panels$100-$500
Fence under 1200mm or damaged$500-$2,500+
Missing or faded CPR sign$20-$50

Run the 20-minute DIY pre-check first, then the full inspection checklist. If you have already failed, what happens next covers deadlines, disputes and rectification quotes.

What it costs in the ACT

The ACT has no pool safety certificate to sell. New pools need building approval with the barrier as part of it, and the ACT Government enforces compliance. A private barrier check before selling or leasing typically runs $150 to $300; rectification is where the money goes: see the fail table above.

What to ask an inspector before you book

  • Which licence or accreditation do you hold, and can I check it?
  • Is one re-inspection included in the fee, and what does a second one cost?
  • Do you lodge the certificate or paperwork, or is that on me?
  • How soon can you come, and can you meet my settlement or lease date?
  • If it fails, will you tell me on the day what to fix and roughly what it costs?
  • Do you do rectification work yourself, or only inspect? (Either is fine; knowing which avoids a conflict.)

Canberra questions

Do I need a pool compliance certificate to sell in the ACT?

No - but the seller's building and compliance report will cover the pool area, and barrier defects surface there. Fixing them before listing is nearly always cheaper.

What standard does a new Canberra pool fence meet?

AS 1926.1 through the building approval: 1200mm height, 100mm gaps, self-closing self-latching gate, clear climb zones. See the fence rule guides.

Are the ACT rules changing?

Reforms toward registration or inspection regimes have been discussed publicly. Nothing here replaces checking the current ACT Government position if you're reading this later.

How soon can I get a pool inspection in Canberra?

Most inspectors offer a slot within a week, and settlement or lease deadlines are usually accommodated within a few days if you say so on the form. The re-inspection after fixes is the step that stretches timelines, so run the DIY pre-check first and fix the cheap items before the first visit.
